Accidents resulting in injuries are painful, scary, and can have long-lasting impacts on your health and way of life.  Broken bones and fractures are no different.  Bones break when there is too much pressure on the bones, causing them to crack or break.  Bones can also break in crush accidents where too much force pins or pinches bones.  Unfortunately, these occur often in accidents like car accidents, truck accidents, motorcycle accidents, and workplace injuries. When a bone breaks because of a car accident, truck accident, or other type of accident, it is known as a traumatic fracture.  If you’ve suffered an accident and have broken bones or fractures as a result, we can help get you money you deserve to help you recover from the injury and traumatic event.

What are common types of fractures?

Fractures or broken bones can be displaced or non-displaced and open or closed.  A displaced fracture is a bone that is broken into two or more pieces.  Non-displaced fractures are when the bone is broken but not out of alignment. An open (or compound) fracture is a fracture or broken bone that protrudes through the skin.  When the break is a compound fracture, there is a much higher risk of osteomyelitis.  Compound fractures (where the skin breaks) are much more serious than closed (simple) fractures.  Similarly, displaced fractures are more difficult to heal than one that is non-displaced.

Skull fractures from an accident

Fractures of the skull, no matter the size, should be taken very seriously.  Accidents where the head is hit hard enough can cause a fracture, even a hairline fracture.  Victims who are in accidents that cause a skull fracture also have a high likelihood of a traumatic brain injury (TBI).  Skull fractures can be life threatening.  A depressed skull fracture is when the skull is pushed inward; there may be parts of the bone pushing against the brain.  A surgeon must carefully remove to relive pressure on the brain.  A comminuted skull fracture is when the skull shatters into fragments.  Again, surgery is necessary to remove pieces of the bone.  A basilar skull fracture is a break to the base of the skull; this can cause nerve damage to the cranial or facial nerves.  Symptoms of a skull fracture include blood welling up in the sinuses and cerebrospinal fluid leaking from the nose and ears.

Vertebral and spinal fractures

Neck and back injuries are common in car accidents.  Sometimes, the accident and pressure is so severe to cause a break.  These are catastrophic injuries and traumatic accidents.  Broken bones in the neck or back are typically painful and may be difficult to repair.  Unfortunately, because the nervous system is located within the spine, back and neck injuries can result in diminished mobility or even paralysis.  If a piece of a broken bone cuts, presses too hard, or pinches the spinal cord, this can cause permanent injury such as paralysis.

If you are able, we recommend keeping a journal or daily log after a serious injury like a fracture or broken bone.  Journals help you remember what you may have felt at the time of the injury, help you recall details, feelings, your surroundings, and possible struggles you were facing.  A journal can be in many forms – it can be handwritten, typed, spoken on your phone, video recorded.  Journals can also help with mental health after a catastrophic injury.

That is a massive amount of machine moving at high speeds.  Occupants can be slammed against interior structures such as the steering wheel, dashboard, seats, doors.  In addition, flying objects can strike occupants and break bones.  Arms, legs, ribs/chest, hands, and feet are often broken in car crashes.  We help represent those individuals to recover compensation for their medical bills, pain and suffering, and other damages available.  Contact an experienced South Carolina car accident lawyer today to help with you broken bone injury.

How much is my fracture or broken bone case worth in South Carolina?

Every case is different and, therefore, it depends.  However, if you hire an experienced and creative attorney like Keibler Law Group, they can rely on top resources, experts, and technologies to convince a jury, the court, and opposing counsel to pay more.  No one can determine how much any case is worth without first analyzing the facts. However, there are certain factors you can use to make an approximate estimation of your claim.

First, you must look at the “economic” damages or those you can quantify.  Then you can recover additional, “non-economic” damages for pain and suffering and other damages that are more difficult to quantify. Finally, depending on the particular circumstances, you may be able to recover punitive damages – or damages designed to punish the wrongdoer and deter future bad actors.

The main factor that will affect the value of your claim is the damages, or losses you incurred. The more damages involved in the case, the more your claim is worth because you can be compensated for all of them. Some of the most common forms of damages include

  • Medical expenses
  • Future medical expenses
  • Future therapy treatments
  • Lost income
  • Pain and suffering
  • Loss of earning capacity
  • Permanent disfigurement or disability

Since broken bones and fractures are painful and typically require medical treatment and rehabilitation, there certainly are damages in your case.

are required to carry a significant amount of insurance, there is a fairly “large” pool of money to recover for your injuries.  However, depending on the severity of the accident and the number of victims involved, that “pool” of money can quickly disappear as victims’ damages accumulate.  It is important to contact an attorney quickly after a bus accident to ensure you get the compensation you deserve.

What is a Contingency Fee?

How do I pay for the lawyer?

We work on a contingency fee basis meaning the victims we represent pay nothing at all unless we win.  Once you receive money from either a settlement or verdict, we receive a certain percentage of that settlement or verdict. If your lawsuit is unsuccessful, you will not owe us any attorney fees.  This allows the plaintiff to reap the rewards without risk of having to pay for a loss.

How long do I have to bring a claim for a fracture or broken bone in South Carolina?

Three years.  Most likely you have three years from the date of the injury.  In South Carolina, you have three years from the date of an accident or injury to file a personal injury lawsuit.

If the negligent party is a government entity such as a school or hospital, the South Carolina Tort Claims Act requires you sue within two years of the accident or injury. Contact an experienced South Carolina broken bone attorney today to see if you have a case.
